2. Making a Contract with us

2.1 When placing order with us, you are offering to buy the goods and we will send you an e-mail to confirm that we have received and accepted your order.

2.2 Should the goods no longer be available or we have made a pricing mistake, we will e-mail you to let you know as soon as possible. We will then process a refund (which can take 3-5 days to appear in your bank).

2.3 Images and descriptions of products on this website are provided in good faith and show the product as accurately as possible. However, we cannot guarantee that your display will accurately reflect the colour of the actual goods and they may vary slightly from the image shown on the website.

2.4 By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.

2.5 This contract is covered by English law.

 

3. How to place an order

3.1 You can use our website to place by selecting products and adding them to your basket and you can update your basket at any time.

3.2 Carriage charges will be shown prior to you placing your order.

3.3 You will be asked to pay for the goods in full at the time of ordering. 3.4 We use secure payment facilities and you can pay for your on-line order by Visa, Mastercard, Amex, ApplePay, GooglePay or PayPal.

3.5 All prices quoted on our website are in UK pounds and include Value Added Tax at the appropriate current rate.

3.6 Prices stated during on-line promotions apply to purchases on the web-site and apply only during the period stated.

 

4. Delivery & Carriage Charges

 4.1 Goods will normally be dispatched within 1-2 working days of us accepting your order. Any estimated dispatch date is an estimate, which can change without notice.

4.2 We use a number of delivery services and delivery times are subject to their service levels at any given time.

4.3 We may despatch your order as more than one delivery but this will not change the carriage charged.

4.4 We can deliver anywhere in the UK and many other places. Some large items will be identified on our website as collection only. Collection is from the Etcetera physical shop at 1 Churchgate, Hitchin, SG5 1DN.

4.5 We will deliver the goods to the address specified on your order. We will not accept responsibility for loss or damage if you instruct the delivery company to leave the goods unattended.

4.6 It is not possible to change the delivery address once items have been dispatched.

4.7 Please check the goods on delivery and notify us of any damaged or missing items within 48 hours of delivery. 

4.8 If goods are lost or damaged in transit, please let us know promptly. It will be necessary to wait the pre-requisite time as laid out by the delivery company before we are able to process official lost in transit claims and refunds.

4.9 Sometimes we may be prevented from dispatching your goods as planned for reasons beyond our control. We will try to put things right as soon as possible but cannot be responsible where this causes a delay or failure in delivering your goods.

4.10 Time is not the essence of the contract unless expressly stated otherwise in writing by a Director of the Company.

 

5. Liability

5.1 We supply goods intended for reasonable domestic and private use. We cannot be responsible for any loss or damage if you use goods for commercial purposes or resell them.

5.2 We ensure that we use reputable commercial software and security systems. You are responsible for keeping your account details confidential. If you believe your account has been compromised, please contact us immediately.

5.3 Damage to your computer. We make every effort to ensure that this website is free from defects or viruses. It is your responsibility to ensure that you use the correct equipment when using the website and to protect from anything that may damage it.

 

6. Data protection and privacy

6.1 We will treat all information according to the requirements of relevant regulations (GDPR). Your details (order, name, address/es contact details and IP address) is supplied to us to allow us to process your order. We do not hold onto your payment details.

6.2 We will share your details with our employees so they can process orders and send them to you. We may share your details with our suppliers, where we have an arrangement in place for them to fulfil orders directly. Our suppliers will only use your details to prepare and send your order to you.

6.3 We will only contact you regarding your specific order, we do not use your data for marketing purposes unless you have given us specific permission to do this.

7. Law

7.1 These Terms and Conditions of Sale shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.

7.2 These terms and conditions, together with our Privacy Policy, constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website.

7.3 Force Majeure. Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event Outside Our Control including but not limited to any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.
